1.         SUMMARY

           The Qatar Airways and Viber Pay 2024 Contest (the “Contest”) is sponsored by Qatar Airways Group Q.C.S.C. with its registered office at P.O. Box 25550, Doha, State of Qatar (the “Sponsor” or “Qatar Airways”). The Partner is Viber Media S.a r.l., a company duly organized under the laws of Luxembourg, with offices at 2, rue du Fossé, L-1536 Luxembourg, Grand Duchy of Luxembourg (the “Partner” or “Viber Media”). The Contest is in no way sponsored, endorsed, administered by or associated with Viber Media whose only role is the operator of Viber Pay.‎ ‎The Contest and Prize are subject to these Official Rules which form a legally binding agreement with respect to this Contest between the Sponsor and the Participant (as defined in sub-clause 2.1 below).  Please read them carefully. If you do not agree to these Official Rules, you are not eligible to participate in the Contest or to win the Prize. The decisions of the Sponsor and the Partner are final and binding on all aspects of this Contest as permitted by law. The Contest is run and sponsored by Qatar Airways in complete independence from any local government offices or tenders.  

2.         ELIGIBILITY

2.1        The Contest is open to legal residents of Greece, and Cyprus (“Eligible Countries”) who are 18 years of age or older as of the date of entering the Contest who have activated Viber Pay in their Viber account on Viber app (each a “Participant”).

2.2        Each Participant confirms that they meet all eligibility requirements set out under sub-clause 2.1 above (the "Eligibility Requirements").

2.3        Employees, officers, directors and agents of Qatar Airways or Viber Media, each of their immediate family members (spouse, parents, siblings, and children) and household members are not eligible to participate in the Contest.

2.4 Only new subscribers in Qatar Airways marketing newsletter are eligible to participate in the contest

3.         AGREEMENT TO THE OFFICIAL RULES

            All Participants must comply with these Official Rules. All interpretations of these Official Rules by Qatar Airways are final. You agree that registration for this Contest and/or a submission of an entry in the Contest constitutes your agreement to these Official Rules and that you are legally bound by them. By participating in the Contest, you agree to these Official Rules and that all interpretations of these Official Rules by Qatar Airways are final as permitted by law.

4.         CONTEST PERIOD

4.1        This Contest commences on the 23^rd September 2024, at 00:00 (Greece time) and will end on the 06 October 2024, at 23:59 (Greece Time), or any extended date which the Sponsor may in its sole and absolute discretion decide (“Contest Period”). 

5.         HOW TO PARTICIPATE IN THE CONTEST

5.1        Provided that the Participant meet the Eligibility Requirements provided under Clause 2 above, the Participant can enter the Contest by completing all the 3 steps detailed below during the Contest Period:

5.2        No purchase is necessary to participate in the Contest or be eligible to win the Prize.

5.3        Participant can enter the Contest only once. Subsequent multiple entries from the same Participant will be void and will not be considered for the Contest.

5.4       Qatar Airways reserves the right to disqualify any Participant who provides false information, fails to provide information or conspires with others to gain an unfair advantage, or is otherwise involved in any way in manipulating, interfering, or tampering with the conduct of the Contest.

5.5. As stated in clause 2.4 only new subscribers in Qatar Airways marketing newsletter are eligible to participate in the contest

6.         PRIZE

6.1       Subject to the Prize restrictions stated in clause 8 below, and the eligibility and entry requirements stated in clauses 2 and 5 above, one confirmed Winner will win the following:

Grand Prize: 

Two (2) roundtrip Economy Class tickets on Qatar Airways’ network from either Greece, or Cyprus to the Maldives.

The approximate retail value is up to United States Dollars Two Thousand (USD 2,000) per ticket hence, a total of United States Dollars Four Thousand (USD 4,000) for the Prize.

6.2       Each Participant of the Contest will receive an up to 12% odd promo code to be used for flight booking on www.qatarairways.com or Qatar Airways’ official mobile application (the “Discount”). The Discount is subject to the terms and conditions provided below.

7.         WINNER’S SELECTION

7.1       On 14 October 2024, the entries of the qualifying Participants who have successfully performed step 1, step 2 and step 3 set out in sub-clause 5.1 above will be placed into a computerised random draw which will not be viewable by the public. From the Participants, One (1) winner will be selected (the “Potential Winner”) by Qatar Airways.

7.2       The Potential Winner will be sent a prize announcement (“Prize Announcement”) from Qatar Airways official account via an email to the email address provided by the Participant at the time of registration in the Contest. The Potential Winner is required to respond to the Prize Announcement by email and confirm acceptance of the Prize within one week from the time he/she receives the Prize Announcement.  If the selected winner is from Cyprus, then the winner will need to answer a simple question with the acceptance of prize.

7.3       The Potential Winner is required to sign and return via email the affidavit of eligibility and liability release (collectively, the “Release”) provided by the Sponsor within ten (10) days of dispatch of the Prize Announcement, together with all or any additional documents or details which Qatar Airways may require, in order to receive the Prize.

7.4       Qatar Airways may request to be provided evidencing document for verification of the Potential Winner’s age, identity, email address and residential address.

7.5       If the Potential Winner meets all of the requirements of this Clause 7, then the Potential Winner will be deemed to be a “Winner”. If a Potential Winner:

(i) does not meet the Eligibility Requirements;

(ii) does not respond to the Prize Announcement within the period specified in sub-clause 7.2 above by the Sponsor;

(iii) does not wish to receive a Prize;

(iv) refuses or fails to provide verification information requested by the Sponsor;

(v) fails to return the Release within the specified timeframe;

(vi) does not react to the Prize Announcement; or

(vi) is disqualified on inter alia any grounds refer to in these Official Rules or any grounds in Qatar Airways’ sole and absolute discretion,

that Potential Winner’s Prize will be forfeited and an alternate Potential Winner will be drawn using the same computerized random draw for selection.

If a Potential Winner is not awarded a Prize for any of the reasons set out in sub-clause 7.5, then at Qatar Airways’ sole and absolute discretion, the Prize in question may either be completely forfeited (i.e., no replacement winner will be chosen), or the selection process described in sub-clauses 7.1-7.5 may be repeated. In case where the selection process described in sub-clauses 7.1-7.5 is repeated, the alternate Potential Winner may be contacted after the deadline specified under sub-clause 7.6.

7.6       The Winner will be contacted by 17 October 2024.

7.7       The chances of winning depend upon the number of Participants.

8.         PRIZE RESTRICTIONS

8.1        The Prize is provided “as is” and without any warranty, representation or guarantee, express or implied in fact or in law and of any kind or nature, and without any implied warranty of merchantability (or other warranty as to quality) or fitness for a particular purpose to the fullest extent permitted by law, and subject to the applicable terms or policies of the Sponsor. A Potential Winner who is ineligible for a Prize, or is unable to or who does not accept or utilize a Prize, for any reason whatsoever, will have no claim against the Sponsor for any reason whatsoever and arising out of whatever cause. 

8.2        The Prize is non-extendable, non-transferable and non-cashable. No cash redemption or prize substitutions by Winner are allowed except where applicable laws require otherwise.

8.3        Winner is responsible for any and all fees, charges and taxes applicable to the Prize, which may not be issued without payment for taxes including withholding taxes and fees. Where required by law, Winner may have to pay withholding taxes to Sponsor for the latter to fulfil its tax obligations.

8.4       Sponsor reserves the right in its sole and absolute discretion to disqualify any Participant or Potential Winner who tampers or attempts to tamper with the entry process or the operation of the Contest, provides false information, fails to provide information, conspires with others to gain an unfair advantage, or is otherwise involved in any way in manipulating, interfering, or tampering with the conduct of the Contest, or violates the Official Rules, or acts in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

8.5        The Participant will not make any claim against the Sponsor or the Partner and its agencies for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilised in this Contest which may limit the ability to participate or by any human error which may occur in the processing of the Entries in this Contest. Sponsor reserves the right to modify or cancel the Contest in accordance with applicable laws if it becomes technically corrupted or for no reason at all. In such event, Sponsor will award Prize via random drawing from eligible entries received prior to cancellation.

8.6       Viber Media shall not be responsible for any activity resulting from the Contest, to the maximum extent permitted by applicable law.

8.7        Prize Restrictions: Economy Class Roundtrip tickets

(i)      Winner must travel from an airport in its country of residence (i.e., Greece, or Cyprus), to the Maldives on Qatar Airways’ network no later than by 30^th September 2025 (for the return ticket). Multicity or multisector tickets are not permitted.

(ii)      The Prize tickets are for the use of the Winner and a companion of his/her choice only. The Prize tickets shall not be transferable to any other person for any reason whatsoever. Winner and companion must travel together and must have valid government-issued documents as required for the itinerary and be legally able to travel without a legal guardian or parent.

(iii)    All travel arrangements must be booked through Qatar Airways local office in Winner’s country of residence at least twenty-one (21) days prior to the proposed date of travel and in compliance with instructions given to the Winner by Qatar Airways. Once a flight booking has been confirmed, no changes are permitted. If the booking is cancelled, no alternative tickets will be issued and no compensation or refund for inter alia the tickets, taxes or any other charges paid for by the Participant shall be provided.

(iv)    The validity period for the use of the Prize tickets may not be extended and the Prize tickets cannot be rebooked once issued. If the Prize is not redeemed, no compensation will be provided. Prize tickets must be issued until 31st March 2025. After this date the Prize will be forfeited and no tickets will be issued.

(v)     Sponsor is not liable for any expense incurred as a consequence of a flight cancellation or flight delay.

(vi)    The Prize tickets will be issued as electronic tickets.

(vii)   The issuance of the Prize tickets is subject to availability, and is subject to change in the sole and absolute discretion of Sponsor.

(viii)  Flight schedules are subject to change without notice.

(ix)    Flight is subject to Qatar Airways Conditions of Carriage available at https://www.qatarairways.com/en-qa/legal/conditions-of-carriage.html .

(x)     Winner is responsible for any and all, fees, security and passenger facility charges applicable to the Prize, which may not be issued without payment for taxes and fees (except as specified otherwise in the voucher).

(xi)    Winner is responsible for the arrangement and cost of visa(s), passport(s), and transportation to and from the point of origin, meals, health documents required and other travel expenses unless stated otherwise (including in respect of any quarantine or isolation requirements that may be in operation in any jurisdiction).

(xii)   The Prize tickets do not entitle the Winner and ticket holder to any mileage credit as part of the Qatar Airways Privilege Club program or any other Qatar Airways reward programs. The Prize cannot be used in conjunction with any other promotion or promotional fare offer by Qatar Airways or third party.

9.         PUBLICITY RELEASE

If a Winner consents, Sponsor will collect and use the Winner’s name, country of residence and/or photograph for advertising, promotional and/or publicity purposes addressed to the general public in all forms of media, including, but not limited to,  on Sponsor’s website, mobile application, social media and on Sponsor’s social media official accounts in connection with the Contest, without any obligation or consideration or counterpart whether financial or otherwise, except for the awarding of the Prize to the Winner. In case that the Winner intends to create any publicity regarding his/her win on the Contest and/or Prize, such publicity must not contain anything that would harm and/or be detrimental to the Sponsor’s or Partner’s reputation.

10.        PRIVACY

10.1     Personal data submitted in connection with the Contest will be processed to allow you to participate in the Contest, allow Sponsor to administer the Contest, where you are a Potential Winner to inform you of this, to process the delivery of and distribution of the Prize, to measure the response to Contest and for any other purposes disclosed in these Official Rules. We will process your personal data based on the Official Rules of this Contest, in accordance with Qatar Airways Privacy Notice (as may be amended from time to time) located at https://www.qatarairways.com/en/legal/privacy-policy.html and as permitted by law. If you decline to provide the information required for your participation in the Contest, we will not be able to enter you into the Contest or award you the Prize.

10.2      As Sponsor and Partner of the Contest, Qatar Airways and Viber Media may process your name, email address, country of residence, age verification documentation and personal identification documentation in accordance with applicable laws. They will retain any personal data provided for a maximum of ninety (90) days from the travel date or a reasonable period in accordance with internal retention policies in order to administer these Official Rules. You agree and acknowledge that Viber Media may process your personal data for the purposes of the Contest. Viber Media will process your personal data in accordance with its Privacy Policy available at https://www.viber.com/en/terms/gdpr-privacy-rights//.

11.       RELEASE OF LIABILITY

A Potential Winner who is ineligible for a Prize, or is unable to or who does not accept or utilize a Prize, for any reason will not make any claim against the Sponsor, its subsidiaries, affiliates, divisions, employees, officers, directors, representatives, mandataries, and agents, (collectively, the “Releasees”). Nothing in these Official Rules will operate to exclude or restrict any liability that cannot be excluded or restricted in respect of death or personal injury resulting from negligence, for fraud or fraudulent misrepresentation or for any matter for which it is not permitted by law to exclude or limit, or to attempt to exclude or limit, liability. SPONSOR'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE CONTEST SHALL BE LIMITED TO THE VALUE OF ONE PRIZE. THE RELEASEES‎ SHALL NOT BE LIABLE TO PARTICIPANTS FOR ANY SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE CONTEST OR THESE OFFICIAL RULES INCLUDING LOSS OF PROFIT, OR REVENUE. NOTHING IN THESE OFFICIAL RULES SHALL OPERATE TO EXCLUDE OR LIMIT SPONSOR'S OR ITS AFFILIATES' LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM SPONSOR'S OR ITS AFFILIATES’ NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION OR FOR ANY OTHER LIABILITY WHICH MAY NOT BE EXCLUDED OR LIMITED BY LAW.

QATAR AIRWAYS MAY WITHDRAW OR CANCEL OR POSTPONE THE CONTEST TO LATER DATES WITH OR WITHOUT A REASON WITHOUT INCURRING ANY LIABILITY OR COST WHATSOEVER AS A RESULT OF USING THIS ENTITLMENT. HOWEVER, ONCE A PRIZE HAS BEEN AWARDED AND A POTENTIAL WINNER HAS BECOME A WINNER, SUCH WITHDRAWAL, CANCELLATION OR POSTPONING WILL NOT OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIBER MEDIA AND EACH OF ITS AFFILIATES, AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SERVANTS OR AGENTS SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGE ARISING FROM YOUR PARTICIPATION IN THE CONTEST OR ANY OTHER CLAIM RELATED IN ANY WAY TO THE CONTEST/CONTEST. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF VIBER MEDIA HAD BEEN ADVISED OF THE POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH THE CLAIM IS BASED.

EVERYTHING ON VIBER MEDIA IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED. PARTICIPANTS AGREE AND ACKNOWLEDGE THAT ALL PRIZES ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING RESULTING FROM ANY ACTS OF ANY GOVERNMENT OR AUTHORITY.

BY PARTICIPATION IN THE CONTEST, YOU HEREBY RELEASE VIBER AND EACH OF ITS AFFILIATES AND SUBSIDIARIES AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS, TO THE MAXIMUM EXTENT PERMITTED BY ANY APPLICABLE LAW, FROM AND AGAINST ANY AND ALL LIABILITY, LOSS, CLAIMS, DEMANDS OR ACTIONS OF ANY KIND WHATSOEVER WITH RESPECT TO INJURIES, DAMAGES, OR LOSSES, TO PERSONS OR PROPERTY, WHICH MAY BE SUSTAINED IN CONNECTION WITH SUBMITTING AN ENTRY, PRIZES, PARTICIPATION IN THE PROMOTION OR WITH RESPECT OF ANY ASPECT OF THE CONTEST/CONTEST.

12.       FORCE MAJEURE

EXCEPT AS OTHERWISE EXPRESSLY SET OUT IN THESE OFFICIAL RULES QATAR AIRWAYS AND ITS SUBSIDIARIES, AFFILIATES, DIVISIONS, AND ITS EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS, AND VIBER MEDIA SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY FAILURE TO PERFORM, OR DELAY IN PERFORMANCE OF, ANY OF THEIR RESPECTIVE OBLIGATIONS THAT ARE CAUSED BY EVENTS OUTSIDE OF THEIR REASONABLE CONTROL. QATAR AIRWAYS IS NOT RESPONSIBLE IF THE CONTEST TERMINATES OR ANY PRIZE CANNOT BE USED OR REDEEMED DUE TO ACTS OF GOD, WAR, TERRORISM, EXPLOSIONS, FIRES, FLOODS, EPIDEMIC, PANDEMIC OR OTHER NATURAL CALAMITIES, BAD WEATHER, STRIKES, RIOT, CIVIL DISRUPTION, INTERNET FAILURES, OR ACTS OF THE WINNER, OR FOR ANY OTHER OCCURRENCES WHICH ARE OUTSIDE OF QATAR AIRWAYS’ REASONABLE CONTROL.

13.     DISCLAIMERS

Where permitted by law, if this Contest cannot be administered as contemplated for any reason which is not caused by Sponsor, Sponsor reserves the right in its sole and absolute discretion in accordance with applicable laws to modify or terminate the Contest Winner selection, or Prizes without prior notice.

14.     GOVERNING LAW

This Contest including the Official Rules in addition to all issues and questions concerning this Contest will be governed by the laws of the State of Qatar, and is subject to the exclusive jurisdiction of the competent Qatari courts. THIS CONTEST IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

Where, in relation to contracts with consumers (being individuals acting in a private capacity), the laws of your country of residence (“Laws”) require that:

1. The Laws shall apply to any such contract; and

2.  You may bring proceedings in the courts of your country of residence (“Courts”),

then the Contest and these Official Rules shall be governed by the Laws and shall be subject to the exclusive jurisdiction of the Courts.
