The Qverse virtual reality application (“Qverse”) is owned and operated by Qatar Airways Group Q.C.S.C a Qatari Shareholding Company located at Qatar Airways Tower 1, Airport Road, State of Qatar.
BY ACCESSING, USING, OR DOWNLOADING QVERSE YOU INDICATE YOUR AGREEMENT TO BE BOUND BY THESE TERMS OF USE ("TERMS OF USE") – YOU SHOULD MAKE SURE THEREFORE THAT YOU READ THEM CAREFULLY BEFORE USING QVERSE. IF YOU DO NOT AGREE TO BE BOUND BY ANY PROVISION OF THESE TERMS OF USE YOU SHOULD DISCONTINUE YOUR USE OF THE PRODUCT.
1.1 Qatar Airways offers you access and use to Qverse for your own personal use without cost. By downloading or using Qverse, you represent and warrant you have all the necessary authority to enter into and comply with the terms of this agreement and that you are of the applicable legal age in the territory where you are a legal resident to access and use Qverse in accordance with its terms and conditions.
1.2 With respect to your use of the Qverse App and its content including but not limited to feedback, questions, comments, ideas, suggestions, know-how, concepts and techniques etc (“the Content”), you acknowledge and agree that
(i)Where the Qverse App is used at your premises (or any premises not owned or leased/hired by us), and mobile internet access is not provided by Qatar Airways, you shall remain responsible at all times for any costs associated with any internet access used as a result of your use of the Qverse App.
(ii) Your use of the Qverse App is for your own private and personal purposes. You are prohibited from any commercial use of the Qverse App. You will not advertise or promote any products or services on or in connection with the Qverse App without the prior written consent of Qatar Airways.
(iii) Qatar Airways reserves the right (but is not obliged) to monitor and review all uses of the Qverse App and all Content and may in its sole discretion and without notice remove or edit Content or withdraw access to the Qverse App for whatever reason.
(iv) You acknowledge and agree that use of the App is dependent on you having a compatible hardware device and compatible software on such device, all of which are your responsibility.
(v) You further acknowledge and agree that Qatar Airways has the right to suspend and terminate your use of the Qverse App if Qatar Airways believes that you have breached any of the above conditions of use.
2. NO ENDORSEMENT
We do not endorse or in any way vouch for the accuracy, completeness, truthfulness or reliability of any Qverse App, opinion, advice, communication, information or other content on or made available through the Qverse App. None of such content should be construed or understood to constitute or reflect the views or approval of us or our service providers or any content providers. We do not recommend that such content be relied on for reaching important decisions or conclusions without appropriate verification and, as appropriate, professional advice.
3. DISCLAIMER OF WARRANTIES, LIABILITY AND RESPONSIBILITY
YOU EXPRESSLY AGREE THAT USE OF THE QVERSE APP IS AT YOUR SOLE RISK. NEITHER WE NOR ANY OF OUR INFORMATION OR CONTENT PROVIDERS, SERVICE PROVIDERS, LICENSORS, EMPLOYEES OR AGENTS WARRANT THAT THE QVERSE APP WILL BE UNINTERRUPTED, SECURE OR ERROR FREE OR OPERATE AT SPECIFIC PERFORMANCE LEVEL; NOR DO WE OR ANY OF OUR INFORMATION OR CONTENT PROVIDERS, SERVICE PROVIDERS, LICENSORS, EMPLOYEES OR AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE QVERSE APP, INCLUDING ANY SPECIFIC PERFORMANCE WARRANTIES. THE QVERSE APP IS DISTRIBUTED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, EXCEPT FOR THOSE WARRANTIES, IF ANY, WHICH ARE IMPLIED BY, AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER, THE LAWS APPLICABLE TO THIS AGREEMENT. WE FURTHER DISCLAIM ANY LIABILITY OR RESPONSIBILITY FOR THE TIMELINESS, DELETION, MIS-DELIVERY, OR NON-DELIVERY OF THE CONTENT, WHICH CONTENT MAY BE ORIGINATED BY INDEPENDENT PUBLISHERS AND/OR PROVIDERS. WE CANNOT AND DO NOT WARRANT THE ACCURACY OF ANY OF THE INFORMATION AS ORIGINATED BY SAID INDEPENDENT PUBLISHERS AND/OR PROVIDERS, AND WE SHALL NOT BE LIABLE IN ANY MANNER WHATSOEVER FOR ANY ERRORS, OMISSIONS, OR INACCURACIES RELATING THERETO. IF DEFECTIVE, YOU - NOT OURSELVES, OUR DEALERS, DISTRIBUTORS, AGENTS, EMPLOYEES NOR ANY THIRD PARTY CONTENT PROVIDER - ASSUME THE CONSEQUENCES RESULTING THEREFROM.
NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY OURSELVES, OUR DEALERS, DISTRIBUTORS, AGENTS, EMPLOYEES OR ANY THIRD PARTY CONTENT PROVIDER, SHALL CREATE ANY WARRANTY IN OR TO THE QVERSE APP OR THE CONTENT, AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM NATION TO NATION.
4. LIMITATION OF LIABILITY
4.1 Qatar Airways, including its employees, agents and sub-contractors, shall not be responsible or liable for any direct, indirect, special, exemplary, incidental, consequential, punitive or other loss, costs, expenses or damages of any kind, or any damages whatsoever, including but not limited to those resulting from loss of profit, loss of contract, goodwill, data or information, loss of savings, business opportunities or revenue, whether or not advised of the possibility of such damage, arising out of or in connection with your use of and/or reliance on the content of or services on the QVerse App, or any linked websites, regardless of whether liability is based on breach of contract, tort (including negligence) or warranty, arises under a statute or any other legal basis for liability.
4.2 Any implied terms, conditions or warranties are excluded to the full extent permitted by law.
4.3 In the event any implied terms, conditions or warranties are contained in legislation that cannot be excluded, such term, condition or warranty will be deemed to be included, however, Qatar Airways’ liability in such situations will be limited to either repairing, replacing or supplying (or paying for the repair, replacement or supply of) goods equivalent to the goods to which the breach relates, or re-supplying or paying for the re-supply of services in the case of any breach relating to services.
4.4 Qatar Airways liability regarding claims under these Terms of Use (whether in contract, tort, negligence or as a result of statutory liability or otherwise) shall be limited to the amount of United States Dollars (USD100) to the extent permitted by law. Liability arising under a statute which cannot be lawfully excluded is not excluded by these Terms.
5. INDEMNITY
You agree to indemnify Qatar Airways and their respective Qverse App providers against all claims, liability, damages, costs and expenses, including but not limited to reasonable attorneys’ fees, arising out of or related to your use of the Qverse App, your violation of this Agreement, and your violation of any rights of any other person.
6. PROPRIETARY RIGHTS
6.1 Material on the Qverse App including but not limited to text, video, audio, graphics, icons and images are owned or licensed by Qatar Airways are protected by copyright law and are copyrighted to Qatar Airways unless otherwise credited. The names, logos and trademarks are the property of their respective owners. No names, logos or trademarks on the Qverse App may be used without the prior written consent of Qatar Airways or their respective owners.
6.2 As a user of the Qverse App you have been granted a limited, personal, non-exclusive, non-transferable and revocable license to use the content of the Qverse App for your personal and non-commercial use and for no other purpose. To the full extent allowed by law, you agree and acknowledge that you will not reproduce, re-use, copy, imitate or distribute any part of or any content on the Qverse App without the prior written consent of Qatar Airways.
7. UPDATES
These Terms of Use may be revised and updated from time to time by Qatar Airways without notice to you. You can review the current version of the Terms of Use at any time on the Qatar Airways website. You will be deemed to have received notice of any changes upon us notifying amendments on the Qverse App, and you will be deemed to have agreed to any such amendments to the Terms of Use when you next use the Qverse App.
Qverse app can only be downloaded from qatarairways.com/Qverse and can only be used on Oculus devices for now, and more VR devices in future. Qatar Airways does not promise that it will always update the app so that it is relevant to you and/or works with the iOS,Android, PlayStation, any personal PC or Mac versions that you have installed on your device.
The Qverse App may become available on Oculus Store. The requirements for use of that system may change and you will need to download the updates if you want to keep using the app. Qatar Airways does not promise that it will always update the app so that it is relevant to you and/or works with your VR headset. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
8. PRIVACY
Qatar Airways is committed to protecting your privacy and complying with applicable data protection and privacy laws and the protection of your Personal Data that you provide to us. We are not able to identify the age of persons who access and use our Qverse App and do not knowingly collect Personal Data from children.
9. GOVERNING LAW AND JURISDICTION
The Terms of Use shall be governed and construed in accordance with the laws of the State of Qatar. The Qatari courts shall have non-exclusive jurisdiction to adjudicate any disputes, which may arise as a result. To the fullest extent permitted by law, you agree that Qatar Airways reserves the right to bring an action against you in any country it deems appropriate.
10. MISCELLANEOUS PROVISIONS
You agree that if any of these Terms of Use are found to be unenforceable under any applicable law, the unenforceability of that term shall not have any bearing or impact on the enforceability of any of the other terms and conditions and, where applicable, the unenforceable term or terms shall be automatically amended by operation of this clause, to the minimum extent required, so as to make it or them enforceable. The provisions of this Agreement that by their nature are continuing will survive any termination. This Agreement is the entire agreement between the parties with respect to the use of the Qverse App and supersedes and replaces all prior or contemporaneous communications or agreements, written or oral.
